ELSE
Terms of use
Draft, under legal review
Last updated:
ELSE is operated by [Company name]
These terms apply to the use of ELSE: the dashboard for coaches and coaching businesses, the ELSE app for their clients, and this website. By creating an account or using ELSE you agree to them. Our privacy policy explains how we handle personal data.
The service
ELSE gives a coaching business (a coaching account) tools to manage its clients, training, nutrition, habits, forms, chat, tasks and payments records, and gives its clients an app to follow their coaching. Features can change as we improve ELSE; we will not remove a core feature a paying coaching account relies on without reasonable notice.
Accounts
- You must give accurate information and keep your password secret. You are responsible for what happens under your account.
- A client joins a coaching account with a join code from that coaching account.
- A coaching account’s owner decides who is on their team and what each role may do, and is responsible for their team’s use of ELSE.
- You must be old enough to agree to these terms where you live, or use ELSE with a parent or guardian’s permission.
Coaches’ responsibilities
If you run a coaching account, you:
- are responsible for the coaching, training and nutrition advice you give, and for having the qualifications and permits your work requires;
- collect your clients’ data lawfully, tell them how you use it and get any consent the law requires, in particular for health information and progress photos;
- use the data in ELSE only to coach your own clients;
- check suggestions made by Ask ELSE or by generated meal plans before you use them: they can be wrong, and nothing changes until you confirm it.
Not medical advice
ELSE is a tool for coaching, not a medical service. Nothing in ELSE, including generated meal plans and Ask ELSE answers, is medical advice, diagnosis or treatment. Clients should talk to a doctor before starting a new training or nutrition programme, especially with a health condition, an injury, pregnancy or allergies, and should stop and seek help if something feels wrong.
Acceptable use
Do not use ELSE to break the law, to send spam or harmful content, to harass anyone, to access data you are not allowed to see, to test or break our security without permission, to copy or resell the service, or to overload it. We may suspend an account that does.
Your content
You keep the rights to what you put into ELSE (programmes, recipes, photos, messages and the rest). You give us permission to store, process and show it only as needed to run ELSE for you and your coaching account. A coaching account’s owner can export its data at any time.
Fees and payments
Coaching accounts pay ELSE according to the plan agreed with us. Prices and payment terms are set out in that agreement or order. Payments between clients and their coach (packages, subscriptions, receipts) are arrangements between them; ELSE records them but is not a party to them and does not hold the money.
Availability and changes
We work to keep ELSE available and secure, but it may sometimes be interrupted for maintenance or for reasons outside our control. The app may update itself in the background. We may change these terms; if a change is important we will tell coaching accounts and users in advance, and continuing to use ELSE after the change means you accept it.
Ending the service
You can stop using ELSE at any time. Clients can delete their account in the app; coaching account owners can delete their coaching account from the dashboard, as described in the privacy policy. We may suspend or close an account that breaks these terms or that has not paid, after notice where reasonable.
Liability
ELSE is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, or for the coaching, advice or results that coaches provide, and our total liability to a coaching account is limited to the fees it paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of [country], unless the law of your country of residence gives you rights that cannot be waived.
